These Terms and Conditions (“Terms”) govern your use of Manuscriptor (“the Software”), operated by ZK Publisher (“we”, “us”, “our”). By downloading, installing, accessing, or purchasing the Software, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Software.

1. Description of the Software

Manuscriptor is a desktop application designed for writing, formatting, and exporting books. The Software operates offline and does not require continuous internet access, except where explicitly stated (e.g., optional downloads, license activation).

The Software is provided in:

  • A free version with limited features.
  • A Pro version, unlocked via a one-time license purchase.

2. License Grant

When you purchase a Pro license, you are granted a non-exclusive, non-transferable, revocable license to use the Software on your personal device(s).

You may:

  • Use the Software for personal or commercial writing projects.
  • Export books for publication or distribution.

You may not:

  • Resell, sublicense, rent, or distribute the Software or license key.
  • Modify, reverse engineer, decompile, or tamper with the Software.
  • Circumvent or attempt to bypass license restrictions.

3. Free Version and Pro Features

The free version allows users to test the Software before purchase.

The Pro license:

  • Unlocks additional features.
  • Does not change the core functionality of the Software.

Users are encouraged to test the free version before purchasing Pro.

4. Payments and Pricing

All payments are processed by Paddle, our authorized payment provider.

  • Prices are listed in USD unless stated otherwise.
  • Taxes (VAT, sales tax) may be applied by Paddle where required.
  • We do not store payment information.

5. Refund Policy

Purchases are subject to our Refund Policy, which is incorporated into these Terms by reference.

By purchasing a Pro license, you acknowledge that:

  • The Software is a digital product.
  • Delivery is immediate.
  • Refunds are not guaranteed.

Please review the Refund Policy before purchasing.

6. Updates and Changes

We may:

  • Release updates, patches, or improvements.
  • Modify or discontinue features at any time.

There is no obligation to provide ongoing updates or future features, though we may do so at our discretion.

7. User Responsibility

You are responsible for:

  • Backing up your data and manuscripts.
  • Verifying export results before publication.
  • Ensuring compliance with third-party platforms (e.g., Amazon KDP, IngramSpark).

We are not responsible for:

  • Publishing rejections.
  • Formatting requirements changing on third-party platforms.
  • Data loss due to user error or system failure.

8. Third-Party Services

The Software may generate files intended for use with third-party services (e.g., Amazon KDP).

We are not affiliated with, endorsed by, or responsible for any third-party platform. Compliance with third-party requirements is ultimately the user’s responsibility.

9. Disclaimer of Warranties

The Software is provided “as is” and “as available”, without warranties of any kind, express or implied, including but not limited to:

  • Fitness for a particular purpose.
  • Accuracy of output.
  • Error-free operation.

We do not guarantee that the Software will meet all user expectations or publishing requirements.

10. Limitation of Liability

To the maximum extent permitted by law:

  • We shall not be liable for any indirect, incidental, or consequential damages.
  • Our total liability shall not exceed the amount paid for the Pro license.

This includes, but is not limited to, loss of data, lost profits, or publishing issues.

11. Termination

We reserve the right to terminate or revoke a license if:

  • These Terms are violated.
  • The Software is misused or tampered with.

Upon termination, you must stop using the Pro features.

12. Governing Law

These Terms shall be governed and interpreted in accordance with the laws applicable to the operator’s jurisdiction, without regard to conflict of law principles.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Software after changes constitutes acceptance of the updated Terms.
